1. Who you are contracting with. These Terms govern your access to and use of MindForge (the "Service"), operated by Kimberley Williams, trading as MindForge (the "Company", "we", "us"). By creating an account or using the Service you agree to be bound by these Terms.

2. Eligibility. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use MindForge. If you are using MindForge on behalf of an organisation, you confirm you have authority to bind that organisation.

3. Accounts and credentials. You must provide accurate information, keep your login credentials confidential, and are responsible for activity under your account. Notify us immediately of any unauthorised access.

4. Acceptable use. You agree not to use the Service for unlawful, fraudulent, harassing, or deceptive purposes; upload malware, scrape, probe, or interfere with the Service or its infrastructure; infringe intellectual property, privacy, or publicity rights; resell or share account access; or generate content that violates academic-integrity rules where prohibited.

5. Your content. You retain ownership of documents and inputs you upload. You grant MindForge a limited, worldwide, non-exclusive licence to host, process, and display your content solely to provide the Service to you.

6. AI-generated outputs. MindForge uses AI to generate study materials. Outputs may be inaccurate or incomplete and should not be relied on as professional, legal, medical, or financial advice. You are responsible for verifying outputs, particularly for graded coursework or examinations. You are responsible for your prompts and for having rights to the content you input. We may remove or restrict content and suspend accounts that breach these Terms.

7. Intellectual property. The Service, including its software, branding, and design, is owned by Kimberley Williams and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

8. Subscriptions, payment, and billing. Paid plans renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 9. Pricing changes. We may update plan pricing with at least 14 days' notice for the next renewal cycle.

10. Refunds. See our Refund Policy.

11. Trials. Free trials are limited to one per person/household and may convert to a paid subscription unless cancelled before the trial ends.

12. Suspension and termination. We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time from the Profile page.

13. Service availability. The Service is provided "as is" and "as available". We do not guarantee uninterrupted, timely, or error-free performance.

14. Warranties. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

15. Limitation of liability. Our aggregate liability for any claim arising out of these Terms or the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages. Nothing limits liability for fraud, death, or personal injury where such limitation is prohibited.

16. Indemnity. You will indemnify Kimberley Williams from claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

17. Privacy. We process personal data as described in our Privacy Notice.

18. Third-party services. The Service integrates third parties (payment processing, hosting, AI providers, email). Their terms govern your use of those components.

19. Changes. We may update these Terms from time to time. Material changes will be notified in-app or by email.

20. Governing law. These Terms are governed by the laws of the jurisdiction of the Company's principal place of business, without regard to conflict-of-laws rules.
